CR08 + Access97 won't export or view unless 'save with data'

Using Crystal 2008 and Access 97 Database

First off thanks for this piece of software!

My problem is I am trying to setup a simple export but the automated export crashes the CrystalCMD and closes with an error. If I save the report with data the export goes smoothly but obviously nothing is really being updated. When i copy over the command line to a bat file and run that so i can see whats going on I get

"Unhandled Exception: CrystalDecisions.CrystalReports.Engine.DatasourceException: Failed to load database information.

If i try and manually export same thing happens. If i save the data with the report everything works fine.

Any ideas would be appreciated I am stumped.
